Electronic Communications Policy and Consent

You agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively, “Communications”) that we, Deserve, Inc., and Customers Bank, provide in connection with (a) your application for a Customers Bank credit card; and (b) your credit card account, if your application is approved and you are issued a credit card. Your consent gives us permission to communicate with you electronically in regard to any activity related to the Customers Bank credit card.

Communications include, but are not limited to:

• communications about your credit card application, including your interest rate, APR, and the final credit limit of your credit card;

• terms and conditions and policies you agree to, including updates to these agreements or policies;

• initial or periodic disclosures, including notices or disclosures about a change in the terms of your credit card or account or associated payment features or responses to claims;

• all legal and regulatory disclosures and communications associated with the credit card or your account; and

• privacy policies and notices.

We will provide these Communications to you by either (1) posting them on the Customers Bank Credit Card website; (2) sending them via the email you provided at application or (3) by providing access to a website that we will designate in an e-mail notice we send to you at the time the information is available using the email you provided at application.

You have the right to request paper copies of any Communication, provided that such request is made within a reasonable time after we first provided the electronic Communication to you. Paper copies can be requested by emailing [email protected] or calling Customer Service at (866) 405-0824. We do not charge a fee for paper copies. If you withdraw your consent, the withdrawal of your consent will not affect the legal validity or enforceability of prior electronic disclosures and communications.

We reserve the right, but assume no obligation, to provide a paper (instead of electronic) copy of any Communication that you have authorized us to provide electronically.

All Communications in either electronic or paper format from us to you will be considered “in writing.” You should print or download for your records a copy of this disclosure and any other Communication that is important to you.

You acknowledge and agree that your consent to electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that this act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.

We reserve the right, in our sole discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.

In order to access and retain electronic Communications, you will need: a working email account; a computer with an Internet connection; a current version of a program that accurately reads and displays PDF files (such as Adobe Acrobat Reader); a current web browser that includes 128-bit encryption and with cookies enabled (e.g. Internet Explorer version 11.0 and above, Firefox version 52.0 and above, Chrome version 55.0 and above, or Safari 9.1 and above); and sufficient storage space to save Communications or an installed printer to print them. You represent and agree that you have access to the necessary equipment and software described herein to receive and save/print Communications to you.

If you withdraw your consent prior to completing your application, you will not be able to complete the application process and therefore will not be issued a credit card.
